Terms of Service

The terms that apply when you use this website or engage Lightning Paralegal Services, LLC to prepare documents for you.

The short version: we are a document preparer, not a law firm, and we cannot give legal advice. We prepare what you ask us to prepare, from the information you give us, for a flat fee agreed in advance.

We are not a law firm

Lightning Paralegal Services, LLC is a certified legal document preparer, licensed by the Arizona Supreme Court under certification AZCLDP #82162. We are not a law firm, we are not attorneys, and we do not practice law.

Nothing on this website, and nothing communicated to you by phone, email, or in person, constitutes legal advice or creates an attorney-client relationship. We do not tell you what you should file, what your legal rights are, whether you have a good case, or how a court is likely to rule. Those are questions for a licensed attorney.

If your matter requires legal advice or representation, we will tell you so and refer you to an attorney. We may not and will not answer legal questions, and you should not rely on anything from this office as a substitute for the advice of a lawyer.

What we do

At your direction, we prepare legal documents, complete court forms, file documents with the court, arrange service of process, and organize records and case files. We prepare documents you ask for, based on the information you provide.

You are responsible for the accuracy and completeness of the information you give us. We prepare documents from that information; we do not independently verify it, investigate facts, or confirm that a filing is appropriate for your circumstances.

Your responsibilities

By engaging us you agree to provide accurate and complete information, to tell us promptly about any deadlines, court dates, or notices you receive, and to review every document we send you before it is filed or signed.

Arizona law requires that certain documents be signed by you, notarized, or filed by a particular date. Missing a deadline can have serious consequences. While we track deadlines you tell us about, the ultimate responsibility for meeting court deadlines remains yours.

Consultation and quotes

The initial consultation is free, takes about fifteen minutes, and does not obligate you to engage us.

Where we quote a flat fee, that fee covers the documents and services described in the quote. It is agreed before work begins and does not change because the work took longer than expected. Court filing fees, certified copies, postage, and third-party charges such as process server fees are not included and are billed separately at cost.

A quote is valid for thirty days unless we say otherwise, and it is based on the facts you describe. If your matter changes materially, we will tell you before continuing and may revise the quote with your agreement.

Payment

Payment terms are provided with your quote. Unless we agree otherwise in writing, work begins after you approve the quote, and documents may be withheld until payment is complete.

Court fees and third-party costs must be paid before they are incurred. If a filing fee goes unpaid, the filing does not happen and the deadline may pass.

No guarantee of outcome

We prepare documents to the current requirements of the court where they will be filed. We cannot and do not guarantee that a court will accept a filing, grant a request, or reach any particular result.

Courts may reject filings for reasons outside our control, including local rule changes, incomplete information from you, or judicial discretion. If a court returns a filing for a defect in our preparation, we will correct it at no additional charge.

Corrections, cancellations, and refunds

If you cancel before we begin work, any payment made toward the flat fee is refunded in full. If you cancel once work has started, we may retain an amount reflecting the work completed to that point, and we will tell you what that amount is.

If we have made a mistake in preparing your documents, tell us. We will correct it at no charge and re-file where necessary.

Confidentiality

We hold your information in confidence as described in our Privacy Policy. Note that communications with a legal document preparer are not protected by the attorney-client privilege, which applies only to communications with a licensed attorney acting in that capacity.

The content on this website is provided for general information. It is not legal advice, may not reflect the most recent changes in the law, and should not be relied on for any particular matter.

The text, layout, and design of this website belong to Lightning Paralegal Services, LLC. You may not reproduce it for commercial purposes without our written permission.

Links to third-party websites are provided for convenience. We do not control those sites and are not responsible for their content or their privacy practices.

Limitation of liability

To the fullest extent permitted by Arizona law, our total liability arising from your engagement or from use of this website is limited to the amount you paid us for the specific matter giving rise to the claim.

We are not liable for indirect, incidental, or consequential damages, including lost opportunities or the consequences of missed deadlines that you did not tell us about.

Governing law

These terms are governed by the laws of the State of Arizona. Any dispute arising from them or from your engagement with us will be brought in the courts located in Gila County, Arizona.

Changes to these terms

We may update these terms from time to time. The effective date at the top of this page will change when we do. Continued use of this website after a change means you accept the updated terms. Terms in effect when you engaged us govern that engagement.
